Professional indemnity insurance – PI insurance (or PII), as it’s popularly known – is designed to provide protection against certain liability claims arising from the services, advice, recommendations, or work a business or professional delivers.

If your business provides advice, opinions or other professional services that a client could subsequently claim were negligent or inadequate, PI insurance may be worth considering.

In some professions, however, appropriate PI cover may be a regulatory or professional requirement. For example, SRA-authorised solicitors’ firms must maintain professional indemnity insurance, while architects are expected by the Architects Registration Board (ARB) to have adequate and appropriate cover. Consultancy or specialist services

  • there may be occasions when your client demands that you have arranged suitable PI insurance;
  • if you are contractually obliged by a client to carry professional indemnity insurance, you will need to meet that requirement to comply with the terms of the contract; and

Professional or regulatory requirements

  • certain professional or regulatory bodies may require members or regulated firms to maintain specified levels or types of PI cover.

Is professional indemnity insurance legally required?

There is no general legal requirement for every UK business to hold professional indemnity insurance.

However, certain professions and regulatory bodies may require their members or regulated firms to hold suitable PI insurance. Cover may also be a contractual requirement between you and your clients.
